NURSE AIDE REGISTRIES: STATE COMPLIANCE AND PRACTICES OBJECTIVE To determine State compliance with Federal regulations for
(1) updating the nurse aide registry records of nurse aides who had substantiated findings of abuse, neglect, or misappropriation of property,
(2) removing the records of nurse aides who had not performed nursing or nursing-related services for 24 consecutive months, and (3) to review State nurse aide registry practices.
BACKGROUND
The Omnibus Budget Reconciliation Act of 1987 contained provisions designed to assure delivery of quality care to long-term care facility residents. Federal regulations (42 CFR § 483.156) require each State to establish and maintain a registry of individuals who have completed training and who the State finds to be competent to function as nurse aides. Nurse aide registries also must include information on any substantiated finding of abuse, neglect, or misappropriation of property made by the State survey agency related to an individual.

I have a comment about administration that believe they are always right. I was working in a NICU in my state, and I was fired because it was said that I did not sense other’s needs before they asked. First of all I want to say that I can usually tell when someone needs something, however, I am not a mindreader and I do not know what they need until I ask. Once I have asked them what it is that they need and they inform me that it is a task with which I cannot assit them (meaning nurses), or they tell me “nothing right now”, and I move on to help someone else, then is it still my fault that they did not receice what it was they needed/wanted? I can answer this myself-NO!! It is not my fault that they did not take to their advantage my services that I was offering them at that time. Further more, most of the time administrative staff, such as the day shift nurse managers, are not always around whenever most of these so called allegations are taking place. And another thing is that my night time nurse managers were always around me and were always praising me for doing a great job and for offering so much of myself to them and the other nurses in the NICU. But it is such a funny thing that when I went in for the ‘meeting’ that I got fired at, the head nurse manager and a lady from the department both informed me that there had been several complaints about my initiative and work ethic, and when I asked her if my night NM even knew that they were terminating my employment with them, her only reply was “No, I have not even spoken with —— yet about any of this”. It is so strange to me that the night NMs are the ones who give report on the CNA/PCAs that work up there, and yet they had know idea that I was being fired, that it had not even been discusd or reviewed with them!! I am here to say right now that I love what I do and I really loved that job. It inspired me even more to go to nursing school, which I am currently enrolled, and plan on studying the area of Neonatal care. I am also here to say that I got delt a poor hand with those individuals, and they lied about me!! If I was in the wrong I would have admited it and gladly taken what I deserved. But the truth is that I am a very hard worker and care about all of those that I care for everyday, whether in pediactrics or geriatrics, and I just do not feel it is fair for them to punish me and not even investigate the false statements against me. I have moved on from this experience, but I wanted other CNAs to know that if something like this has ever happened to you, there are still fellow aids who are here for you to help you through, and that the ‘powers that be’ in the front office really are not always right!!
